Terms of Service

These Terms of Service (hereinafter referred to as “TOS”) govern the procedure for providing 3v-Hosting services and define the rights and obligations of the parties. By placing an order, paying for the service, or actually using the server, the customer confirms that they have read these terms and conditions and accept them in full.

The services are provided by FOP “Bondarenko Oksana Vladimirovna,” registered in Ukraine. All contractual relationships are governed by the laws of Ukraine.

The parties recognize the legal validity of electronic documents and correspondence carried out through the client panel or email.

In the event of a dispute, the parties undertake to attempt pre-trial settlement of the dispute. If no agreement is reached, the dispute shall be considered by the courts of Ukraine in accordance with applicable law.

3v-Hosting provides virtual server (VPS) and dedicated server services intended for independent use by the customer.

All VPS are currently provided in an unmanaged format. This means that the provider ensures the operability of the infrastructure, hypervisor, and network environment, but does not administer the operating system, install software, configure services, or provide support.

The customer is solely responsible for server configuration, software updates, security settings, vulnerability protection, and the correctness of the content hosted.

The provider does not interfere with the operation of the client's software, except when necessary to protect the infrastructure, eliminate security threats, or comply with legal requirements.

Services are provided on a prepaid basis for the selected period. The start of service provision is considered to be the moment of its activation in the client panel.

For virtual servers (VPS), there is a 7-day money-back guarantee from the moment of the first activation of the service. A refund is possible if there are no violations of these terms and conditions and no abuse of the infrastructure.

For dedicated servers, no refunds are provided, as such services involve the reservation of physical resources. No partial refunds will be made for unused periods.

In the event of disputed payment transactions, the provider has the right to temporarily suspend the provision of services until the circumstances are clarified and the payment systems have completed their verification.

In order to protect the network infrastructure and maintain the reputation of IP addresses outgoing connections to standard SMTP ports (25, 465, 587) are restricted by default.

These ports are opened upon individual customer request after assessing the intended nature of use.

In the event of abuse, complaints about spam activity or other activities that could affect the reputation of IP addresses or the provider's autonomous system, 3v-Hosting reserves the right to immediately re-restrict SMTP traffic or temporarily shut down the server without prior notice.

Protecting the reputation of the network is a priority, as violations may result in blocking at the level of international operators and partners.

The customer undertakes to use the services exclusively for lawful purposes and to comply with international and national legislation.

It is prohibited to post malicious software, participate in botnets, organize DDoS attacks, fraudulent schemes, mass mailings without the consent of recipients, as well as any content or activity that could lead to the blocking of IP addresses or autonomous systems.

Upon receiving justified complaints or identifying violations , the provider has the right to restrict access to the service, suspend it, or terminate service without compensation.

A daily snapshot is automatically created for VPS, which is stored until the next backup snapshot is created.

Snapshots are provided as a backup measure and do not replace a full backup strategy.

No backups are performed for dedicated servers. The customer is solely responsible for the safety of their data.

3v-Hosting is liable only for direct, documented damage caused by the provider.

The maximum amount of liability is limited to the amount paid by the customer for one calendar month of using the relevant service.

The provider is not liable for lost profits, indirect losses, loss of data, actions of third parties, or the consequences of the customer's use of the services.

The provider is exempt from liability for failure to fulfill its obligations in the event of force majeure circumstances, including military actions, sanctions, data center disruptions, actions of upstream providers, backbone network failures, government restrictions, cyber attacks, BGP filtering, IP address blocking, and other events beyond the reasonable control of the provider.

The provider has the right to temporarily restrict or completely terminate the provision of services in the event of a violation of these terms and conditions, a threat to network security, or the receipt of mandatory requirements from competent authorities.

In cases where the continued operation of the server may cause damage to the infrastructure or third parties, the server may be shut down immediately without prior notice.

3v-Hosting reserves the right to change these Terms of Service as services develop and legislation changes.

The current version is published on the website and comes into effect from the moment it is posted.
